These requirements are
for lot owners in Bighorn Hills Estates Subdivision (BHH) to implement the
covenants required for building. It is the responsibility of the property owner
to ensure all the following requirements are met prior to the commencing of any
excavation on any lot in BHH.
1. Complete and sign the building application below and submit to the Architectural Control Committee (ACC)
at Board@bhhe.org. Submission of plans showing construction details, square
footage, floor plans, elevation, siding and roof type and color. Electrical, plumbing and
framing details are not needed. Computer versions of plans are preferred.
2. Submission of a plot plan identifying placement
of structure on lot including septic system, driveways, etc. Description
of trees removed and any changes to the lot. All building setbacks must include
all permanent structures including eves, decks, etc.
3. Receipt of a $8,000 water access fee.
4. Receipt of a $4,000 deposit, which may be
refundable to ensure repair of any damage to the subdivision properties such as
roadways, water lines etc. assure all building requirements are met and lawyer
expenses and late fees paid. This is only a deposit; the member is responsible
for all cost of repairs and fines. The deposits may not be refunded should any
of the requirements on this page not be met per the ACC’s interpretation and
until project completion. Includes obtaining a certificate of occupancy or
final ACC inspection. It is the owner’s responsibility to close out their
project with the ACC. This is to be done by submitting the County Certificate
of Occupancy. Should this not occur within 90 days of suspected completion.
All funds will be retained.
5. The footprint location of the buildings and
driveways are to be staked on the lot and approved by an Architectural Control
Committee member or its designee. This is to ensure all required setbacks from
property lines are met. A minimum of 72 hours’ request needs to be provided.
The member is responsible to assure surveyed property lines are correct and a
sting line must be strung on all adjoining property lines throughout
construction.
6. Provide sanitation facilities on site during
construction starting with the excavation of the site.
7. There will be a minimum of 72 hours’ request given
to the Board prior to hooking up to the subdivision water system. A water
committee member, or a knowledgeable Board member, or designee, will be on site
during any water hookup. We recommend that water hookup contractors familiar
with the BHH water system be utilized to accomplish the water hookup. A list is
available from the BHH board. No water hook-ups allowed after October 1, nor
before May 1.
8. When building is complete, drainage from
subdivision roadway to property must be maintained to facilitate water runoff.
This can be accomplished either by a culvert or a drivable dip capable of
handling drainage. If a culvert is required, the county will furnish the size
required.
9. You will have 1 year from the time of footing excavation
to complete construction. A 6-month extension may be granted by the ACC if
requested in writing prior to the completion of the initial year. Should
construction not begin within the year of approval, approval is rescinded and
you must resubmit plans and work through the process again.
10. Other association building requirements i.e.
setbacks, etc. may be found in the Covenants, Conditions and Restrictions
(CCRs) Article VI Architectural Control and VII Use Restrictions, and By-Law VI
Section 2 Architectural Control Committee.
11. Pursuant to CCR Article 7.1. “No multiple story
buildings shall be built unless specifically approved by the board with due
consideration for the scenic views of other Lots in the Subdivision” The Board
has defined that any structure above 18 feet above native ground levels is
considered a multiple story building and must be specifically approved by the
Board. The Boards standing policy is and has been to send plans of structures
to the adjoining lot owners to assess their potential concerns with view and
harmony with the surrounding area.

Section 2. And Section 8 have adopted these rules for its own government and
have found them not to by inconsistent with these By-Laws and have been voted
on and approved by the board on 12/17/2020 with revisions on 9/8/2025.

submit this Application to the Architectural Control Committee of the Bighorn
Hills Estates Subdivision and further certify and agree to the following:
1. I
understand that the applicable CCR’s for Bighorn Hills Estates Subdivision
provides that “No building, fence, wall or other structure shall be commenced,
erected or maintained upon any Lot, nor shall any exterior addition to or
change or alteration therein be made upon any Lot until the plans and
specifications showing the nature, kind, shape, height, materials and location
of the same shall have been submitted to and approved in writing as to the
harmony of exterior design and location in relation to surrounding structures
and topography … by an architectural committee composed of three (3) or more
representatives appointed by the Board.”
2. I
understand that the applicable CCR’s for Bighorn Hills Estates Subdivision
provides that “No multiple story buildings shall be built unless specifically
approved by the Board with due consideration for the scenic views of other Lots
in the Subdivision.” I agree that a multiple story building is any building with
a height over 18 feet or living space on multiple levels even if the living
space is in an attic.
3. No
work with respect to the proposal set forth in this Application may be
performed prior to receipt by Applicant of written approval thereof from the
Architectural Control Committee. Should work not commence (footing excavation)
within one year of ACC approval, approval is rescinded and a new application
will be submitted.
4. All
information, plans, specifications, data, and supplemental materials submitted
with and in respect to this Application are complete, true, and correct. No
construction, changes, alterations, or work associated with the proposal set
forth in this Application shall deviate in any way from the plans,
specifications, and other documents submitted herewith and any terms and
conditions contained within any approval of this Application, and any such
deviations shall be timely corrected at Applicant’s expenses. Any
alterations between what is approved by the ACC and what is constructed without
prior approval will be subject to a Five Hundred ($500) Dollar per day charge
until the non-conforming construction is corrected. Any construction, change,
alteration, or work initiated but not completed by the indicated and approved
End Date shall be subject to a daily fine of $50.00 per day until completed,
unless an extension has been granted in writing by the ACC. The ACC may
grant a six-month extension. However, it
is the members responsibility to request this prior to the construction
deadline.
5. Applicant
shall be bound by the Amended Declaration of Covenants, Conditions and
Restrictions for Bighorn Hills Estates Subdivision, and all rules adopted by
the Bighorn Hills Estates Property Owners Association, Inc. The applicant
agrees to pay all legal fees and costs incurred by the Association to enforce
any rule, regulation, covenant, restriction, or agreement concerning the
subject of this Application.
6. Applicant
has no unpaid assessments, dues, fines, or penalties owed to the Bighorn Hills
Estates Subdivision or the Bighorn Hills Estates Property Owners Association,
Inc.
7. Applicant
shall be responsible for obtaining any permits or authorizations from the
County or the State of Idaho as may be necessary for the proposal set forth in
this Application. All work performed in furtherance of the proposal set forth
in this Application shall conform with all building and fire codes as may be
applicable thereto. No approval of this Application shall ever be construed as
representing or implying that the associated plans and specifications will
results in a properly designed structure or satisfy any legal requirements.
8. Applicant
is responsible for following the Bighorn Building requirements and must
coordinate stake inspection and water hookup with the ACC. 72-hour request will be made.
9. The
Board of Directors or their designated official has the right and will be
allowed to inspect the premise during various stages of construction to assure
compliance with approved plans.
10. Applicant
shall be responsible to request any road or building refundable fees. The failure to request a refund of the
remaining fee within 90 calendar days from the issuance of the Certificate of Occupancy
will be deemed a forfeiture of any remaining refundable deposit. Decisions
on whether applicant will receive any or all refundable deposits is at the
discretion of the (ACC or HOA) board. And their decision will be binding
on all parties.
